Law 23/2007 (commonly referred to as the Foreigners Law), recently amended by Law 18/2022, of 25/8, has now been regulated by Regulatory Decree No. 4/2022, of 30/9, which will enter into force on October 30, 2022.
The following main changes result from all these acts:
• Temporary stay visa and residence permit for digital nomads
In situations of subordinate work, the application for a visa must be accompanied by documents attesting to tax residence and average monthly income in the last three months of minimum value equivalent to four guaranteed minimum monthly wages and by one of the following documents:
- the employment contract
- promise of employment contract;
- declaration of employer proving the employment relationship.
In the case of self-employed activity, the application must be accompanied by documents attesting to tax residence and average monthly income in the last three months of minimum value equivalent to four minimum monthly salaries guaranteed by one of these documents:
- Articles of Association;
- Service contract or proposed service contract;
- Document demonstrating services provided to one or more entities.
• CPLP Visa Applicants
Applications for the granting and renewal of residence permits submitted by nationals of CPLP Member States are exempt from:
- presentation of valid travel insurance;
- proof of means of subsistence;
- copy of the return ticket;
- face-to-face presentation to apply for a visa;
In addition, the visa application is granted an injunction, and the CPLP residence visa confers the right to apply for the CPLP residence permit.
• Visa for job search
To apply for a visa to look for work, it is necessary:
- declaration of conditions of stay;
- proof of presentation of declaration of expression of interest for registration in the IEFP;
- proof of possession of means of subsistence equivalent to three minimum monthly remuneration
This visa may also be extended, taking into account the reasons that justified its grant, if accompanied by proof of registration IEFP and declaration of the applicant with indication of the maintenance of the conditions of stay
